I bought the HPPE2 book but it did not come with the accompanying CD. Is there any way to get the CD or download the tools without buying the book again? The book came from an book dealer referenced on Amazon so I'm not sure if the book was sold 'as is' or if I even have a legitimate complaint with the dealer.

(Check your Amazon account for recent purchases to find the link.) If the CD was missing, it should have been mentioned in the ad text. If the ad did not specify "No CD," then you definitely have grounds to request the seller "make it right." When this type of thing has happened to me, sellers have offered a refund or (if they had one) to send a book with the CD. Amazon provides a means to e-mail sellers through one's account, so that's the route I would suggest.
Most sellers would rather "make it right" than suffer lost future sales due to a bad rating and scathing text by PO'd buyers.

Danny is right there. You may be able to contact the publisher if you have trouble with the seller (that would be sybex). I am, believe it or not, unable to sell tools from that version as it is not allowed by contract. I had that changed for later versions.

Thanks Danny and Richard. The vendor quickly refunded my money when I told him that the CD was missing. I bought the book from a different vendor and it had the CD. Thanks for the suggestions.
