| Cropping the text out would be the easiest way, else you are up for a whole heap of cloning and colour matching to reconstruct |

| Not wanting to be obnoxious (but I'm going to be), how about contacting the photographer and asking for permission to use the original? |

| Removing Type Well you could select the type and copy that to a new layer. Lock the transparency in that layer and have at it with the clone tool and brush. |
