Re: Omfg

Hello lovely God Mother. First thing I would do is contact the deepest pockets of the 3. Dior is big but I think Steve Jobs has the heavier wallet. Contact Apple central and ask to speak to their legal department. They will quiz you as they will think you want to sue them. Give them enough to send you through to legal. Give them the web address and they will probably ask to see your orignials as well. Contacting Dior would be not so easy but if MAC corporate gets wind of it, they will surely contact Dior. You need to gather your originals and look in Photoshop to collect EXIF info and also any documentation you may have. I have addressed this issue before and was scolded by some guy who thought he knew better so I let him ramble, blah, blah, blah, blah. This mother is as blatand as it comes and for profit so it add's more mitigating circumstance. Sorry, third edit already. I think first you need to contact the photographers so they can come on board with you and also make sure none of them gave any consent of all, which I am sure they did not. This is about as blatant as it gets.

c - Now YOU have to Let me be your Facebook friend..
c

I love it when you use that dirty mouth too, by the way!
Wait, that sounded terrible. How 'bout I love it when you cuss like a sailor

I have created an account, fagged every one of her pictures and wrote this to the adm:

Jul 20 09 10:19 am
How can u allow this??
http://www.modelmayhem.com/pics.php?id=1134537

Lou Denim - the photographer she mentions notified me about this account.

This so called retoucher is using COPYRIGHTED material - most from ME and Lou Denim and some from other TOP retouchers around the world

Feel free to check my folio, or Deviant account or flyckr account or just plain google Natalia Taffarel

If this account is not taken down immediately I WILL take legal actions! and so will MAC and Lou Denim and everyone who's pictures have been STOLEN by this person.

A SHAME about the security on this site!

Re: Omfg

Yes that's a hard one to learn. That's why you honestly got to be careful whether you post stuff at all. I have had three occasions when I have seen work samples from other retouchers that I knew I did at least 90% of the work on.

When it comes to work you put on the web - Natalia - this is yet another reason why you should keep PSD's. Then at least you know if you get the chance to prove to a client you did it, you can.

Happened recently when I had done some visualising and retouching for Sky Sports last year. I discovered one of the retouchers who had worked only on one of the 'offshoots', had put it as a before and after on their PDF, except the 'before' wasn't really THEIR 'before'

I can probe it easy - I posted it first YEARS before her

And I don't need prof for clients. My clients are my friends.
I work based on trust every time and if I don't lie u I can't work for u.

I know it's a lil bit weird but it's the way it is

Re: Omfg

I recognise one of the images from the Lynda.com tutorials:

This one:
http://modelmayhem.com/pic.php?pid=12138220

the photographer's website is rburman.com

I have emailed the photographer to let him know someone is infringing on his copyright. xh

Re: Omfg

no don't think it's that they don't care. they just have to investigate it a little otherwise you could just claim all your competitors were frauds and have their profiles removed. it might take a little while but do what you need to and you'll have them shut down...

there's no way they could verify that every upload is a legitimately copyrighted image...

Re: Omfg

It looks worse than it is - and that's probably whats intended, its just a "we cant be arsed to do anything" standard legal thing. A translation of their requirements … as far as I can see…
1 A written letter clearly stating that you are the 'creator' of the images, and that those images have been directly taken from you AND the Photographers.

A Your signature

B A list of exactly which images on the site that 'High-end anonymous Retouching, Female' is claiming are hers - the ones that you did. You can't copyright them - that's for the photographer, THEY will have copyright

C As above, and a link to the material that you want them to take down "or access to which is to be disabled"

D Your written statement that the photographer who owns copyright, does not authorize the use of those images by 'Retouching, Female" - and needs to be signed.

E A statement of accuracy - just means "…*the information contained in this letter is complete and accurate"
A threat with legal action (advice, doesn't necessarily have to be followed up of course) - that's the best you can do.

I hate them... but better be in it if I'm gonna stop the fakers

I still hate the administrators tho, until they prove they are not arses .

In my country the gob decided to expand winter holidays ¬¬ so I was a full time mother for 2 weeks, couldn't do any work - I was BORED...I don't give out "advices" I just tell ppl what I DO and what I THINK it's right - I'm not the owner of the truth so it's just another opinion.

xx

Re: Omfg

Godmother - still, i think You can take legal actions. Administrators of MM have logs of ppl, who created accounts (ip adresses, which can be quickly converted to physical street, country etc). If You will take more ppl, and do it together, maybe the case will become more popular and knowk, so next time, someine will try to use others work will think about it. The best off all, is that proppably You will not have to pay for legal case, and in the end, only time, that You will spend on searching how to do it correctly (in Yours country) will be needed to finish the case.
Lately i have been talking with my friend from company, that works to take money from debtors. In most cases, ppl dont care to fight for their rights becouse they think it will cost a lot of money, but in reality, if You have rights to something, that have been stoled, You will not take any costs of legal actions.
And if more and more ppl will do, maybe the world will become better .

So why join them? For someone how hates them so much, yu seem pretty active there now. If you want respect from MM, I'd suggest you stop putting them down so much. Your good work will only take you so far. I've found that you spew a lot of hatred. For those MMers that don't read the forums here, they'd probably love to see just how much you hate them.

I don't mean users but the way they conduct the site... well...

Here in Retouch Pro the mods and adm are GENUINELY worried about copyright and everyone being respectful and nice to everyone.

I like the forums and the users. Everyone seems nice in MM

But I never got an email from the Adm saying, everything was taken cared of, sorry for the inconvenience!

BTW: I joined so I could GET the fakers down... the adm don't even let u contact them if u don't have an account!
