Active Layer's name in a new text layer

Hello, I have done an Action with some functions. The part that I am unable to make is to get the name of the active layer and make a new text layer. Usually I get the Layer Properties and copy the layer name (Control C) and then create a new text layer and paste. This copying part doesnt work in an Action. Can scripting do that? I tried learning Scripting and is way over my head now. Can anyone help me with it? thanks.
